Subject: 9543/1989-180/Abandonment (Wiehl Street)/Erlanger Date: Mon, 27 Feb 1989 12:20:00 -0500 1989-180 City of Chattanooga ORDINANCE NO. 9543 AN ORDINANCE CLOSING AND ABANDONING PORTIONS OF BLACKFORD STREET AND WIEHL STREET SOUTHEAST OF HAMPTON STREET NORTHEAST OF EAST 3RD STREET, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned portions of Blackford Street and Wiehl Street southeast of Hampton Street northeast of East 3rd Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Part of Blackford Street and part of Wiehl Street. To find the true point of beginning of said parts of streets, start on the southeast line of Hampton Street some 470 feet northeast of the intersection of the southeast line of Hampton Street with the northeast line of East 3rd Street, said point being the intersection of the southeast line of Hampton Street with the southeast line of the existing Blackford Street, thence northeast some 62 feet with Blackford Street to the southeast line of the proposed relocated Blackford Street, the true point of beginning, thence northeast some 193 feet with the proposed Blackford Street to the northeast line of the existing Blackford Street, thence southeast some 280 feet with Blackford Street to the northwest line of Wiehl Street, thence northeast some 174 feet with Wiehl Street to the southwest line of the proposed Blackford Street, thence southeast some 65 feet with said proposed street to the southeast line of Wiehl Street, thence southwest some 165 feet with Wiehl Street to the northeast line of the existing Blackford Street, thence southeast some 273 feet with the existing Blackford Street to the southwest line of the proposed relocated Blackford Street, thence southeast some 100 feet with the proposed Blackford Street to the southwest line of the existing Blackford Street, thence northwest and southwest some 863 feet with the existing Blackford Street to the southeast line of the proposed relocated Blackford Street, the true point of beginning. Tax Map No. 1360-B-40 & 45, and 146A-J-1 & 6. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The reservation for Jupiter Industries, Inc., d/b/a Chattanooga Gas Company, of an easement the width of the streets for its gas main, lines and other distribution facilities located within the petitioned rights-of-way, which must be maintained for the use and benefit of its customers. 2. The Electric Power Board of Chattanooga has distribution facilities located within said rights-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire rights-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 3. The City of Chattanooga has a sewer located within said rights-of-way and reserves an easement the width of the rights-of-way for the purpose of maintaining said sewer. 4. The reservation for the Tennessee-American Water Company of an easement the width of the rights-of-way for the purpose of operating and maintaining their facilities located within the rights-of-way. 5. The review and acceptance by the City Engineer of the design and construction of the relocation of Blackford Street. 6. The areas reserved for utility easements must be kept free and clear of all structures. 7. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law, provided that this Ordinance shall not be operative until the City Traffic Engineer has accepted the construction of Blackford Street as relocated.
